North Warwickshire builder Mark Anthony Kellegher of Allens Close, Baddesley Ensor Atherstone, Warwickshire, CV9 2DB trading as M A K Building Services Limited has been handed an Enforcement Order by Coventry County Court to trade fairly or face a possible jail sentence for contempt of court.
Warwickshire County Council Trading Standards brought the action after receiving a number of consumer complaints about the business.
James Greenaway, Warwickshire Trading Standards Team leader said: “Home improvements can amount to thousands of pounds and the effects of having this type of work done badly can be devastating financially and emotionally to customers.”
“Trading Standards will continue to monitor this business to ensure that it is complying with the law and will not hesitate to take action if they breach the Enforcement Order.”
At Coventry County Court on 26th April 2017 an Enforcement Order was granted which forbids Mark Anthony Kellegher and his business M A K Building Services Limited from:
• Making false or misleading statements to consumers about delivery dates for goods and services
• Failing to pay suppliers and contractors etc. resulting in customers having to pay themselves,
• Failing to remove waste from customer’s properties.
• Failing to complete work, or
• Demanding extra payment for a piece of work beyond that quoted
Further, Kellegher must now ensure that the work he does is performed with reasonable care and skill, within a reasonable time and at a reasonable price (and no more than that price).
A breach of the order is contempt of court and may lead to a fine, imprisonment or seizure of company assets.
